International and European Standards of State Policy

Abstract

The article deals with theoretical aspects of the definition of the international and european standard. On this basis the international and european standards of state policy proposed to understand as a fundamental, guiding basics (the principles, rules, recommendations, etc.) of the formation and implementation of the state’s policy relating to the approval and provision of accepted international values enshrined in the international documents of universal and regional importance. The concept of the international documents which are provided by Ukraine are analyzed and allocated the standards of formation and realization of state policy that contributed to the conclusion that international and european standards for the formation and realization of state policy do not has a common unified view. They are exist in the form of principles, rules, recommendations, references, characteristics, which are enshrined in international documents (conventions, declarations, resolutions, etc.) and are accepted on a universal level – the Organization of United Nations, and on the regional – the Council of Europe. Managed to determine the primary purpose of these international documents that is means to consolidate the legal and organization basics for the enforcement of fundamental rights and freedoms, activity of the principle of the rule of law, accountability of public authorities under the society, public participation in the formation and realization of state policies, good governance, personal security and the like. By the way, the goal of each international document specifies the content and scope of international and european standards for the formation and realization of state policies, the adoption of which provides for the approval and protection of universally recognized values (rights, freedoms, principles, etc.) by the states which have consented to be bound by the relevant international documents.
