Legal, social and political conditions create a municipal (local) police in Ukraine

Abstract

Experience of local government for the establishment and functioning of law enforcement department’s orientation municipal (local) police, in terms of reform. Emphasized on the fact that Ukraine has accumulated some experience of the police force, created by local governments. In Kyiv, Kharkiv, Severodonetsk, Luhansk region and others in different years were created departments of municipal (local) police, civic formation of public order. Municipalization of public order functions logically from the need for constitutional provisions on the right and the duty of local authorities to carry out their own public order. It is reported that almost the first time in Ukraine's legislation – the Law «On local government in Ukraine» (the Law 1997) was fixed on creation powers of local or municipal (local) police. It is noted that to date the legislation is not fixed mechanism of municipal (local) police, its powers, forms and methods of interaction with local authorities, although it is the unification and coordination of state authorities, local communities in ensuring public safety and combating crime. An example of a positive experience of the municipal (local) police in some countries. It is noted that all divisions indisputable priority belongs patrol: in most Western countries patrolling engaged variously estimated from 60 to 90 % of employees of the municipal (local) police procedure creation, operation, logistical and staffing, of municipal (local) police different, but everywhere can identify patrol component aimed at law enforcement. The conclusion is that ensuring public safety and order is one of the priority areas of the National Police. Given the fact that the criminal situation in the country needs improvement required new approaches and ways to improve the work of all law enforcement agencies including law enforcement tumors. Therefore, the development of new forms and methods of law enforcement, namely the use of municipal (local) police for law enforcement the state is relevant and important. There is need to develop a legal framework and organization of municipal (local) police in Ukraine.
