Perspectives of Further Pre-Trial Investigation Units Reforming in the System of National Police of Ukraine

Abstract

Effective crime prevention depends greatly on adequate structural and functional support of criminal police, investigators and other units functioning. Problem of criminal procedural pressure diversification among pre-trial investigation units is examined. Arguments are provided for establishment of simplified misdemeanor proceedings and delegation of relevant functions to operative units including preventive police and district police inspectors. Similar practice is claimed to be successful in many European countries. Taking the European experience into consideration, we assess the perspectives of detectives’ institute establishment meaning «multifunctional» police officers authorized to perform all types of procedural actions (open and covert) aimed at detection and investigation of criminal offence. Experience of Poland, Czech Republic and Germany is carefully examined in terms of staff professional qualification structure – different categories of positions (7–11) with corresponding statutory requirements to special ranks, practical experience, educational qualification and financial provision of pre-trial investigation units. It is stressed that police officers must be trained in specialized higher educational establishments with unified curricula and further professional specialization. That is why working group of MoI of Ukraine on law enforcement education reforming together with NAIA experts offered an innovative vision of new law enforcement professional training model (basic, special and postgraduate programs – Junior Bachelor, Bachelor and Master’s degrees) with due attention to individual skills, characteristics and experience of every police officer.
