Typical Investigative Situations of Initial Stage of Terroristic Acts Investigation

Abstract
Typical investigative situations arising at the initial stage of pre-trial investigation of terroristic acts were examined. In criminal proceedings (upon the fact of terroristic act committal) initial stage is the most important and strained because investigator needs to take measures on elimination of the committal consequences and at the same time to check the general typical versions of criminal event, and also to collect and fix evidence that may be lost. Results of terroristic act committal, as a rule, lead to promotion of the following versions: 1. Terroristic act is committed by means of explosion near state or military objects or in the premises of public organizations providing volunteer assistance to the Armed Forces of Ukraine or law enforcement bodies in the counter terroristic operation zone. No victims. Person suspected of a terroristic act committal isn’t detained, there is little or no information about his/her personality available to law enforcement bodies. As a rule, such terroristic acts are committed. 2. Public activist, journalist, military or law enforcement officer etc. was the object of terroristic attack by means of explosion. 3. Terroristic act is committed by means of explosion but the suspect died and his personality is unidentified. 4. Next investigative situation is characterized by the fact that terroristic act wasn’t completed and law enforcement officers prevent its committal at the preparing stage in the framework of initiated criminal proceeding. It is important to remember that one of the key factors affecting the typical situations being formed at initial stage is presented by presence or absence of data concerning the criminal’s personal data and detention status.Downloads
