Peculiarities of compensation of moral harm caused by the police

Abstract
This article focuses on the issue of compensation of moral harm caused by illegal actions of National Police in Ukraine. Special attention is given to the determination of the amount of compensation of moral harm, in particular, the practice of leading European countries, considering this issue, is investigated. The options, that may be used by the court of Ukraine while determining the amount of such harm, are observed. These alternatives are: to use the amount, claimed by the plaintiff; to appoint a forensic psychiatrical inquiry; to determine the amount of compensation for moral harm by itself, using the requirements of the Civil code of Ukraine.Downloads
