Grounds and Methods of Criminal Investigation of Offences Related to Labor Security and Safety Rules Violations in Manufacturing and Construction
Abstract
Article provides comprehensive analysis of applicable legislation
provisions, scientific sources and judicial practice in terms of
violations of industrial safety rules at construction sites. Role of
forensic recommendations in improvement of relevant law
enforcement activity is identified. Conceptual framework of forensic
investigation methodology is defined.
It was identified that accidents are typical occurrence sat
constructions its usually caused by direct violations of legislative
provisions and other industrial safety regulations along with unsafe
behave our in the course of hazardous operations performance.
Injuries result in damage to health or fatal outcome, businesses and
state suffer from material damage due to provision of compensation
to employees.
It is proved that prompt and full investigation of such case switch
identification of primary causes would allow to improve the
unsatisfactory statistics, save lives and state budget. Although we
must state that activities performed by relevant state bodies in terms
of abovementioned crimes prevention and investigation do not meet
the formulated requirements. A lot of violations are simply not duly
registered to prevent any delays in the scheduled construction
process and save money potentially to be paid as compensation to
victims. Active resistance is manifested in terms of detection and
investigation of such violations leading to multiple blockages on all
judicial levels. Currently this area of law enforcement activity is one
of the issues requiring urgent improvement.
