Involving of Investigation Experts While Appointing Inspectations in the Process of Criminal Cases with Road Traffic Accidents and Vehicles Operation
Abstract
Nowadays native law study and practice proves, that expertsʼ activity while appointing and passing legal examinations is an important element in investigations of breaking the rules of safety regulations and vehicles exploitation. That is why under studying some investigative practice, science literature and normative legal reports for keeping activity of law enforcing bodies we analyzed the content, subjects, institution, order and circumstances for appointing and passing examinations, which are significant while proving offences in this sphere. At the same time we suggested a wide range of examinations as well as grounds and factors for their appointing and range of conclusions, which give the investigator the opportunity to prove or disprove the fault of specific driver with the help of special expertʼs knowledge and pass a resolution in a criminal case of that offence category. Besides, significant for investigators, that specialize in road traffic accidents, expert mechanics and forensic experts are pointing out at the problem moments, which appear while preparations, appointing and conducting the exams in criminal offences introductions in the offences of that kind. To them we argumentaly refer: collection of investigative information and other facts while investigating the crime scene, vehicles examination, examination of road covering, investigation experiments, especially becoming of biological material, removal of vehicle parts, becoming of samples of varnish-and-paint covering and tracks fixation, getting the data for the examinations according to the system: «driver – vehicle – road – environment».
