Protecting Journalistsʼ Professional Activity: Problems of Cross-Industry Regulation
Abstract
The purpose of the article is to analyze the sectoral and intersectoral aspects of regulation and protection of journalistsʼ professional activity, as well as to focus on the mechanisms of regulation and protection of material and intangible rights in this activity, most of all, the rights of life, health and more. The methodological basis of the study is the dialectical approach, determined by the purpose and object of the article, used in addition to such methods as: analysis and synthesis, induction and deduction, analogy and modeling, abstraction, as well as systemic, structural, functional, comparative ones and so on. Scientific novelty is expressed in the actualization, coverage of problematic issues of sectoral and cross-sectoral regulation, protection of journalistsʼ professional activity. Certain guarantees of the right to freedom of thought and speech, to the free expression of their views and beliefs, in particular, in the professional activity of journalists, have been elucidated. Conclusions. On the basis of the study of the constitutional, civil, criminal and other sectoral legislation of Ukraine, both positive and negative aspects of the protection of journalistsʼ professional activity are covered. The synthesis of cross-sectoral regulatory regulation in this area demonstrates the need to streamline a large body of legislation on the professional activity of journalists, and to improve it. The importance of protecting the form of creative expression of ideas in works due to the professional activity of journalists, their protection in the performance of official duties, protection of honor, dignity, integrity of journalists, and others, is particularly emphasized.
