Finding Out the Signs of Crime during the Pre-Trial Investigation

Abstract

Before the beginning of pre-trial investigation law enforcement authorities carry out the row of measures which are directed on the exposure of acts of criminal activity. Such activity is important, as most crimes are latent. Research workers consider that an exposure of crime is purposeful activity of operative and result subsections for establishment, fixing off acts, circumstances of doing crime and persons, participating in them, and for the receipt of information which can be user as proofs during pre-trial investigation. In the article grounded differentiating of processes and procedures: «operative search of signs of crimes» and «exposure of crimes». An exposure of crimes is the initial stage of investigation, as for him necessary presence of information about the fact (signs) of perfect crime. One of elements of exposure crimes is the establishment of their signs, establishment of persons, objects and phenomena, which are of interest, which is provided complex application of operational and searching measures and consequence (search) actions. It provides the receipt of necessary in formation for comparison. More narrow sense has an operative search, as it is carried out exceptionally by the subjects of operational and searching actions. An operative search must be carried out as taking into account concrete facts, accomplished and registered crimes.
