Specific Object of Crimes under Articles 255, 257, 2583, 260 of the Criminal Code of Ukraine

Abstract
The article defines the specific crime object as common for irect objects of a few related crimes under the same or different chapters of Special Part of the Criminal Code of Ukraine. It is similar to the generic crime object and ensures legal regulation of separate social groups (homogenous or analogous). Two different types of specific crime objects are presented: 1) specified crime object comprising related direct objects of a few crimes limited by one generic object; 2) specified crime object comprising direct primary and secondary objects limited by separate generic objects. It is offered to divide crimes against public security into four groups: 1) establishment and participation in criminal organizations (Art. 255, 256, 257, 2583, 260 of the Criminal Code of Ukraine); 2) terroristic acts (Art. 258–2585, 266 of the Criminal Code of Ukraine); 3) crimes involving violations of special regulations for use and storage of dangerous items and substances (Art. 261–2651 , 267–270 of the Criminal Code of Ukraine); 4) other crimes against public security (art. 259, 2701 of the Criminal Code of Ukraine). According to the abovementioned crime classification four types of specific objects are defined: 1) social relations aimed at prevention of criminal organizations’ establishment and functioning; 2) social relations aimed at prevention of terroristic acts; 3) social relations aimed at public safety maintenance in cases if violations of special regulations for use and storage of dangerous items and substances are detected; 4) social relations aimed at prevention of other public threats. The specific object of crimes under Articles 255, 257, 2583, 260 of the Criminal Code of Ukraine is identified as social relations aimed at prevention of criminal organizations’ establishment and functioning (groups, gangs, terroristic organizations, illegal armed formations) which are subjected to potential damage caused by specified criminal acts committal.Downloads
