Administrative and Legal Support of the Realization of the Citizens Rights to Participate in the Protection of Public Safety and Order

Abstract

The relationship between the concepts of «public» security and order is presented in the article. The needs to involve all state and public institutions and to find effective solutions of existing problems of modern public administration both at the state and local levels are modified. A detailed analysis of the current legislation of Ukraine regarding the use of terms and concepts of «public safety», «public order» is performed. The actual tasks of ensuring public safety and order, aimed at prevention of general criminal situation are researched. Existing forms of citizens’ participation in the protection of public order and safety on the territory of Ukraine are demonstrated. Historical and contemporary international experience of the citizens’ involvement intothe law enforcement activity of such countries as the UK, Germany, Poland, Japan, Austria, Belgium, Ireland, Italy, Switzerland, Denmark, Netherlands, Sweden and France is analysed. An adopted implementation into the activity of certain methodological achievements and practical methods of public involvement in enforcement activity in modern conditions are worked out. The form of public involvement into the protection of public order on an individual basis are found. Legal status of freelance workers and social assistants which is characterized by a high degree of relevance and reflects public service orientation of the units of the National Police is presented. Attention is paid to the peculiarities of the right of citizens to participate in the protection of public security and order at the present stage of reform and to the need for further development of law enforcement and other government agencies for the protection of public order and security as well as to the formation of the relevant legislation and the organizational and technical conditions for self-realization of their rights by the citizens.
