Administrative and Legal Status of Central Banks: International Legal Aspects

Abstract
In this scientific article the international experience of administrative and legal status of national banks. Based on the theoretical analysis of international experience in administrative and legal status of national banks by the author made a number of proposals and recommendations for implementation into national law certain provisions for the regulation of the Central Bank. Investigating administrative and legal status of the National Bank of Ukraine author highlights a number of provisions that are more reveal the powers and jurisdiction of a public body Rates and management as the central figure in the banking system of Ukraine. However, we believe that a more thorough analysis should reveal the legal status of international experience central banks of leading countries and identify reference provisions may implemuntuvaty in Ukraine. Innovation is seen experience of the Central Bank of England on legislative determination and issuance cryptocurrency. However, the positive is the existence in England Banking Code, which is called «fair banking practices manual» (which means «Code bank credit». It defines minimum standards of good banking practice in dealing with customers. Having studied the experience of the Federal Republic of Germany, the Republic of Latvia, the Republic of Slovakia stipulates that among the main functions of the central bank is a function of promoting full employment. It appears significant implementation experience of the Republic of Belarus to expand the functions of the central bank as follows: monitoring organizations based on conduct regular surveys to identify trends in economic processes, analysis and forecasting in conjunction with the tools of monetary policy; conducts according to legislation regulating leasing activity and enforcement of legislation on leasing activity; organize work to improve financial literacy.Downloads
