The Typology of Participation of Para-Military or Armed Formatives not Predicted by Law
Abstract
The classification of persons-participants of para-military units and armed groupsthat are not provided for by the laws of Ukraine is being researched in a comprehensive manner in the article.
The article deals with the influence of the typology of criminal personality on the development of general and individual measures for crime prevention.
The author analyzes the circum stances that determine the creation and function of paramilitary or armed formations not predicted by law in the territory of Ukraine, the mechanism of their interaction and the consequences of the influence on the formation of such kind of criminal associations are examined.
The article emphasizes that the studying of the characteristics of the offenderʼs person, including the inherent nature of the crime of character and property, allows more accurately determine the nature and extent of the public danger of a criminal act, establish the determinants of a specific crime, and after analyzing the information obtained, develop a system of effective measures to prevent the creation of unforeseen by law paramilitary or armed formations.
The author under score that the basis of effective prevention of crimes from among available legal tools, the most important place be longs to the criminological portrait and typology of the offenderʼs person.
It has been argued that the process of crime prevention needs to take in to account the various features of the person committing a crime, since the latter, on the basis of their study, predetermine the further development and selection of classification criteria (typologies) for such persons. Thus, it is possible to distinguish certain types of offenders by systematizing certain criteria of a person.
It is proved that the study of the question of the people-participants of the above-mentioned criminal associations, their classification and typology, has an extremely important role today, since it is intended to serve for the development of a set of activities to prevent the creation of such kind of associations, and may be useful during the investigation of the problem issues of the delineation of responsibilities for the acts committed by people-participants of para-military units and armed groups that are not provided for by the laws.
