Abstract

The article examines the institution of early termination of powers of deputies of local councils and their improvement in the context of decentralization of public authority in Ukraine. It is worth noting the democratic attitude of national legislation to the presence of a criminal record in Deputy of the local Council or candidate for deputies of local councils. Law of Ukraine «About local elections» 2015 year established the ban to run citizens of Ukraine who have a criminal record for committing serious or particularly serious crime, a crime against the electoral rights of citizens or the corruption offence if this record is not paid or not paid in accordance with the law.In my belief, this revision of the electoral law and the law of Ukraine «On the status of deputies of local councils» is not conducive to the formation of moral and professional legislature. So it is worth at the legislative level to consolidate the limitation that Parliament, village, Township, Mayor, Mayor may not be elected citizen of Ukraine, who has a criminal record for committing an intentional crime. And the entry into force of a conviction for committing an intentional crime for which the Deputy local Council sentenced to punishments not related.The effectiveness of the functioning of the deputies of the local councils, the conformity of their activities to the needs and demands of the local communities directly depends on the clarity, consistency and complexity of securing the Institute early termination of powers of Deputies local councils in the national legal framework and requires its improvement through the paradigm of strengthening control of the local community through the institutions of direct democracy, the system of local self-government, that the proper legislative provision in Ukraine has not found.
