Official Work Part-Time of the Policemen
Abstract
The purpose of the article is to identify the problems of combining the police service with other types of paid activity in the context of compliance with prohibitions established by the legislation in the field of preventing corruption, taking into account the practice of its application and the achievements of legal science. An inadequate level of research on anti-corruption restrictions regarding compatibility with other police activities has been established. The existing legislation regulating the order of police officers’ work part-time is analyzed. It is established that the list of permitted types of paid activity for a policeman is more restricted than its types from the general one established by the Law of Ukraine «On the Prevention of Corruption» for other categories of persons authorized to perform the functions of the state and local self-government. The content and directions of the implementation of scientific activities by the police are characterized. The specifics of the creative activity of the policeman (as a form of part-time work) are disclosed, as well as the specifics of the proceedings in relevant cases of administrative offenses in terms of attracting an expert on cultural values as an additional participant in such production, which should establish whether this or that activity is creative in understanding the legislation in sphere of culture.
Different types of activities are distinguished: teaching and scientific-pedagogical. The last one can be carried out by policemen on a paid basis only in higher education institutions, post-graduate education institutions of the Ministry of Internal Affairs and is prohibited in the training centers for police training, including the Patrol Police Academy, which provide primary vocational training and advanced training for police officers. The groundlessness of the restriction of the teaching activity of the police officer to the scientific and pedagogical with regard to the modern reform of the education system of the Ministry of Internal Affairs of Ukraine is proved to be unjustified, which will negatively affect the system of service in the organs and divisions of the National Police.
The order and the time frame of the police officer’s part-time work have been determined, and directions for improving the legislation regarding the combination of the police service with other types of paid activity are proposed, by amending the law on the national police accordingly.
