Execution of Orders of Investigators about Searching Persons who Evade Investigation for Economic Crimes
Abstract
In this article author revealed features of execution of operational units of orders of investigators about searching persons who evade investigation for economic crimes. In process of execution investigator’s orders about searching persons who evade investigation for committed economic crimes main attention related to form of cooperation between investigator and operational: а) processual: instructions from investigator about carrying out secret investigative (searching) action (Articles 40 and 246 Criminal Procedural Code of Ukraine); help to investigator in process of realization secret investigative (searching) (Article 40 Criminal Procedural Code of Ukraine); б) organizational: exchange of information; cooperation; consultations. Author proposed to consider under investigator’s order written demand from investigator to head of operational unit that includes mutual aids, joint and agreed cooperation with division of competences, functions, powers and responsibilities and directed on identification and arrest of persons, who evade from investigation for economic crimes. Is proposed to stop a practice of forming investigator’s issues, that not attitude to investigative (searching) and secret investigative (searching) action. Also proposed to make changes in part 1 of Article 41 Criminal Procedural Code of Ukraine where anticipate the possibility of giving orders by investigator not only for carrying out investigative (searching) and secret investigative (searching) actions, but also for carrying out another processual actions during criminal proceedings.
