АКТУАЛЬНІ ПРОБЛЕМИ РОЗСЛІДУВАННЯ ВОЄННИХ ЗЛОЧИНІВ
Анотація
Анотація. У статті розглянуто питання кримінально-правового та криміналістичного змісту розслідування суспільно небезпечного діяння, передбаченого ст. 438 Кримінального кодексу України «Воєнні злочини». На основі бланкетної диспозиції зазначеної вище статті КК України встановлено, що з метою повного й об’єктивного аналізу складу кримінального правопорушення необхідно проводити співвідношення вчиненого суспільно небезпечного діяння з ознаками, які передбачені нормами міжнародного гуманітарного права у межах вчинення різних форм порушення законів та звичаїв війни. Визначено, що правильність кримінально-правової кваліфікації, а отже, й оцінка дій особи, яку обвинувачують у вчиненні цього кримінального правопорушення, і подальше притягнення зазначеної особи до кримінальної відповідальності, невід’ємно пов’язана з аналізом положень міжнародного гуманітарного права, міжнародних договорів, конвенцій тощо, які мають урегулювати тлумачення воєнних злочинів. Статтю присвячено проблемам, що постають перед правоохоронними органами під час розслідування правопорушень, передбачених ст. 438 КК України. Встановлено, що актуальною проблемою, яка заважає ефективному розслідуванню воєнних злочинів, є активні бойові дії в місцях вчинення злочинів. Зазначено необхідність підвищення кваліфікації (отримання криміналістичних знань) уповноважених компетентних осіб (спеціалістів), за допомогою яких буде забезпечено ефективне розслідування кримінального провадження за фактами воєнних злочинів. Акцентовано, що права людини, зокрема ті, які належать до сфери національної безпеки, підлягають захисту й охороні незалежно від дії особливих правових режимів.
