Правова природа та процесуальні форми використання спеціальних медичних знань під час розслідування воєнних злочинів

Анотація

Анотація. У статті здійснено комплексний теоретико-правовий аналіз правової природи та процесуальних форм використання спеціальних медичних знань під час розслідування воєнних злочинів. Актуальність дослідження зумовлена тим, що збройна агресія російської федерації проти України спричинила масове вчинення порушень законів і звичаїв війни, зокрема вбивств цивільного населення, катувань, насильницьких зникнень, сексуального насильства, незаконного позбавлення волі, руйнування цивільної інфраструктури, а також появу значної кількості невпізнаних, фрагментованих, обгорілих або скелетованих останків. За таких умов спеціальні медичні знання набувають не допоміжного, а системоутворювального значення для кримінального провадження, оскільки саме через них тілесні, біологічні, морфологічні, фізіологічні й ідентифікаційні факти трансформуються в процесуально придатну доказову інформацію. Обґрунтовано, що правова природа спеціальних медичних знань полягає в поєднанні наукової достовірності та процесуальної легітимності. Медичний факт не набуває доказового значення поза межами встановленої законом процедури, натомість належна процесуальна форма забезпечує допустимість, перевірюваність і доказову цінність результатів спеціального дослідження. Визначено основні процесуальні форми використання спеціальних медичних знань у кримінальних провадженнях щодо воєнних злочинів, серед яких: судово-медична експертиза, участь спеціаліста в слідчих діях, огляд місця події та трупа, освідування, ексгумація, відбір біологічних зразків, використання медичної документації, ідентифікаційні процедури, судово-стоматологічні, молекулярно-генетичні, антропологічні та цифрові інструменти. Увагу зосереджено на значенні судової стоматології, електронних реєстрів, геномної інформації та міжнародних стандартів документування незаконної смерті й катувань. Доведено, що ефективне використання спеціальних медичних знань сприяє не лише встановленню фактичних обставин воєнного злочину, а й ідентифікації загиблих, забезпеченню права родин знати долю близьких, зміцненню доказової спроможності національного правосуддя та розвитку сектору безпеки та правопорядку України.
