Prospects of Introduction of Foreign Experience of Using DNA Accounting into the Practice of Ukraine
Abstract
The purpose of the study is to evaluate foreign experience in the use of DNA records in the investigation of criminal offenses and to substantiate the possibility and feasibility of its use in Ukraine. Methodology. To achieve this goal, the author used special research methods, namely: the method of system analysis, comparative law, system-structural and forecasting method. The scientific novelty of the study is that based on the analysis of international legal acts, regulations of some foreign countries, as well as scientific works of domestic and foreign scientists identified the main issues related to the content, functioning and use of human genetic traits in Ukraine. Taking into account the analysis, the author formulated proposals to eliminate certain problematic issues, as well as proposals for reforming the legislation in the context of the research issue. Conclusions. The author substantiates the scientific position that the effective way to solve problems related to the functioning and use of human genetic records in Ukraine is to study and implement best foreign practices, as most countries began to form records at the end of the last century. It is proved that the reform and improvement of the practice of filling, functioning and authorized use of records of human genetic traits should be carried out through the adoption of a special law. The author emphasizes that special attention in determining the DNA profiles of categories of persons subject to registration in the registration of human genetic traits should be paid to missing persons, as well as those who due to mental disorders or senile dementia repeatedly searched by the National Police for their disappearance. It was stated that the development and implementation of the bill should be fully consistent with the strategy for the development of law enforcement agencies, and the costs of implementing all legislative initiatives should be included in the state budget of the year.
