Legal Challenges of Counteraction of Criminality by Operational Units of the National Police of Ukraine

Abstract
While for a long time the police had been operating in almost all post-Soviet countries, in Ukraine it was the structure of militia. The necessity of police had been spoken since the proclamation of independence of the state, but the Parliament adopted the Law of Ukraine «About the National police» on 2nd July in 2015, and the President signed it on August 4th that year. This law says that one of the objectives of the police is to provide police services in the sphere of counteracting the crime. Today the National Police just begin to operate and various aspects of its work are still poorly investigated, including features combating crime by the units of the criminal police. The article highlights the retrospective aspects of the creation of the National police of Ukraine, as well as considers a range of issues related to the legal ensuring of combating crime by the new law enforcement agency. Some legal problems that have arisen in various areas of police work, including counteracting crime are considered. We could avoid this situation, both by preventing flaws in the adoption of this law, and by removing flaws after adoption law but before entry into force. Legal problems of counteraction of criminality by operative units of the National police of Ukraine remained even after the amendments to some legislative acts of Ukraine in connection with the adoption to this law. So, currently legally questionable is legitimacy the creation and functioning of interregional territorial bodies of police. The question arises if these units are right for operational-investigative activity and the fulfillment of written orders of the investigator to conduct secret investigative (detective) actions in criminal proceedings. To resolve the legal problems of counteraction of criminality by operative units of the National police of Ukraine, the author develops and proposes changes to the Law of Ukraine «About the National police».Downloads
