The Polygraph Use During the Pre-trial Investigation of Rapes of Last Years

Abstract
A significant number of rapes remain unsolved due to several reasons, including: the low quality of pre-trial investigators’ (investigative) actions, assigning incomplete and poor quality test versions for persons committing crime, and insufficient use of scientific and technical means. The difficulty in investigating crimes of this category is often caused by victims’ showing insincerity, refusing to file the crime, etc. The use of a scientific and technological device is effective in this case – the polygraph, the use of which during the pre-trial investigation has conclusively proven investigative practices in more than 75 countries. However, today in Ukraine to complete the process of the polygraph use in criminal proceedings is hampered because there is no legislative consolidation of the polygraph as a legitimate scientific and technological device in Ukraine. Therefore, the relevance of scientific articles is that the absence of special legislation giving the right to admit evidence of test results using the polygraph, holding back the development of the research on the subject, which does not allow the full use of the possibilities of this method for gathering evidence during the pre-trial investigation, especially when it comes to investigating rapes of last years. That is why the study of the polygraph use during the pre-trial investigation of rapes of last years requires further research and regulation.Downloads
