Using the Results of Investigative Journalism in Criminal Procedural Proof

Abstract
In the article the issues are related to the use of investigative criminal procedural proof. In foreign countries, investigative journalism is widely used in criminal proceedings, but in Ukraine this question was relevant only after independence and still on a scientific level not sufficiently studied. One of the promising directions of investigative journalism their use is under the investigation of criminal offenses, in particular to establish evidence-based information in criminal proceedings. Proved that the information obtained during the investigative journalism, is inherently non-procedural, and therefore can’t have evidentiary value in the investigation of the criminal proceedings until they acquire the status of evidence. Materials obtained during the investigative journalism, is the foundation on which to further the criminal process emerging evidence because during journalistic investigation actually is collecting information on the sources of evidence, as well as signs of a criminal offense, the circumstances of their discovery, the person that may be involved in a criminal offense, his witnesses, the location of objects and documents which may be physical evidence of any other facts and circumstances relevant to the investigation and so on. The features of the transformation of non-procedural information received on the results of investigative journalism in evidence. In particular, the process of transformation into evidence the following information: information which carrier is a journalist as a subject of investigative journalism, and others – members of investigations (operator, reporter, a person who provided interviews, etc.); information carriers which the documents gathered during the investigative journalism; information carrier which is directly published material in electronic media investigative journalism. Proved that the use of information technology will inevitably affect the actual performance of law enforcement agencies to review and resolve specific criminal proceedings, including actions to establish evidence-based information. Features electronic media to collect and process information, which based on Investigative Journalism, and can be transformed into evidence during the preliminary investigation, almost limitless.Downloads
