Procedural activity of investigator in terms of suspect’s (accused) property search aimed at recovery of damage under criminal offence

Abstract
Article provides research of current issues on procedural activity of investigator in terms of suspect’s (accused) property search aimed at recovery of damage. Criminals usually don’t provide the voluntary damage recovery and become subjects of mandatory reimbursement. During the initial stage of pre-trial investigation investigators are concentrated on the following tasks: identification of damage character and amount; detection of property expropriated by the criminals responsible for the damage reimbursement; collect data of the property location; identify the legal status of detected property; extract and store property for further damage recovery. Suspect’s or accused property search aimed at recovery of damage under criminal offence defines the following competencies for investigator and prosecutor: receive upon request data on property objects (movable and immovable assets) owned by individuals including suspect and his/her spouse from state bodies, local authorities and officials; receive upon request data on account details of chosen individual or legal body (commercial entity) in financial institutions and relevant information concerning suspect and spouse by the court decision; interrogate coworkers, neighbors and relatives of a suspect as witnesses on property issues; interrogate the suspect with correct application of tactical maneuvers allowing to cover the real aim of investigative action through identification of person’s preferences and interests (entertainment, values, principles, everyday habits etc); receive income declarations of suspect, his/her spouse and other persons; assign operative units to take investigative (detective) actions aimed at detection of property expropriated by suspect and its presumable location. It is stressed that cooperation of investigators with operative units for suspect’s (accused) property search is especially important for damage recovery procedure.Downloads
