Problem of legal reform in the scientific heritage of the academician Volodymyr Kopeichykov

Abstract

The article is dedicated to the problematic issues of legal reform in the scientific heritage of the academician V. Kopeichykov. In educational and scientific fields V. Kopeichykov is known as an outstanding scientist, a distinguished educator, a talented coordinator of scientific activities, one of the leading national experts in the field of the theory of state and law, constitutional law. In the article was coverage the problems of legal reform, especial in the field of academician V. Kopeichykov’s scientific interests. Also, examined the thematic (categorical) of the closeness of legal reform notion, basic directions of scientific researches of the scientist, especially the mechanism of the state, constitutional process, human rights and freedoms of man and citizen, that was due to the direct participation of V. Kopeichykov in government and law-making processes during the first stage of the reformation changes after the proclamation of independence of Ukraine. The problems of legal reform were analyzed in the point and wives of general theoretic and branch scientific works, a summary of which allows speaking about absence of unity in understanding of essence of legal reform, its difference or identity with the state and legal reform. According of this, promising vectors for understanding the nature of legal reform are the study of its essence, content, philosophy, ideology, goals, directions, subject, object, principles, technology, efficiency, relations with other concepts of the theory of state and law. Was generalized that in the scientific heritage of V. Kopeichykov special place are occupied by legal reform issues, its humanistic nature, principles, first of all, scientism, and ways of implementation. These developments which were made by V. Kopeichykov became a step for formation of a qualitatively new theoretical and methodological basis for further research of the nature of legal reform. This ideas found there further research in the scientific developments of the legal reform which was made by V. Kopeichykov’s students, in particular by A. Kolodii – the study of the principles of law and constitutional reform and S. Husariev during the comprehension of theoretical and methodological aspects of legal activities. Also, it should be emphasized that V. Kopeichykov, along with separate aspects of legal reforms, made sense of legal issues reformation developments in other areas of social reality, in particular the reform of secondary and higher education, economic reforms and so on.
