Implementation of administrative regulations in the activities of the ministry of internal affairs of Ukraine and the national police

Abstract

The article considers the problems of realization of administrative procedures in the activities of the Ministry of Internal Affairs (MIA) of Ukraine and the National Police. It is stressed the need to inventory of their state functions, and of government services. The whole functional structure of the MIA and the National Police should be reviewed. The main consequence of such review should become the reducing of duplicative and unnecessary functions. The administrative procedure is described in the article. It is presented an interpretation of the concept of administrative procedure and the ways of its implementation in the activity of the Ministry of Internal Affairs of Ukraine and the National Police. The article disposes the relevance of regulatory consolidation of administrative procedures of the Ministry of Internal Affairs and the National Police agencies and units’ activity. While developing the administrative procedures it is necessary to proceed from the fact that these documents must have higher legal power with respect to other departmental regulatory acts as for the state services provision. It is defined the features of organizational and functional procedures in the National Police units as well as the specifics of pointing of these procedures in the relevant administrative regulations. The author has formulated the general requirements to the regulations of the execution of state functions of the mentioned subjects. It is admitted to inadmissibility of replacement of administrative-procedural legislation (in the part of the legal regulation of the administrative services provision) with taking the relevant regulations only. The above-mentioned administrative regulations should be only the part of the legislation on administrative procedures and should reflect the concept that defined by the general procedural legislation.
