Peculiarities of proving the facts of violating the established regulations for narcotics, psychotropic substances and precursors turnover

Abstract
Analysis of investigator’s actions taken after identifying the facts of violating the established regulations for narcotics, psychotropic substances and precursor’s turnover with establishment of proper procedural actions algorithm taken in the course of pre-trial investigation is provided. The abovementioned algorithm in most cases includes 1) registration of application or notification of the facts of violating the established regulations for narcotics turnover by corporate body/business entity with further placement of relevant data in the Unified Register of Pre-Trial Investigations and initiation of investigation; 2) search of location (premise) where the violation itself took place; 3) examination of seized items and documents with aim to detect the facts of violating the established regulations for narcotics turnover by corporate body/business entity; 4) interrogation of witnesses with aim to identify the facts and circumstances of violating the established regulations for narcotics turnover by corporate body/business entity and preconditions of the crime committal; 5) detention of person suspected in violation of established regulations for narcotics turnover (notification of suspicion); 6) interrogation of a suspect; 7) search of suspect’s and accomplices lodgings and any other facilities potentially used for storage of documents and other evidence of criminal activity; 8) forensic examination procedure; 9) analysis and utilization of expert’s conclusions in the course of investigative actions. In accordance with the Article 91 of the Criminal Procedure Code of Ukraine circumstances subjected to proving during the pre-trial investigation of violation of established regulations for narcotics turnover are defined with full list of investigative actions taken for the circumstances to be proved.Downloads
