Objects of Criminal Offence in Construction Sector

Abstract
Article presents research of objects of criminal offence in construction sector. List of objects traditionally selected by criminals – construction materials, financial assets, other types of property – as criminal offence objects is provided along with description of its interconnection with other elements of crimes classification mechanism. Author performed analysis of scientific approaches, materials of investigative and court practices regarding the identification of crime object concept and characterized the peculiarities of interconnection between the objects of criminal offence in construction sector and other elements of relevant crimes classification. It is stressed that construction materials and financial assets are commonly selected as objects of criminal offence in construction sector. Аuthor notes that financial assets gain the status of criminal offence objects if possessed through fraudulent activities involving use of citizens’ assets for construction funding and other schemes involving embezzlement mechanisms (inappropriate use of construction/refurbishment budget). Аuthor stresses that in cases if embezzlement schemes led to financial assets extraction criminals tend to conceal all personal data and use complicated methodology to cover any traces of illegal activity and avoid liability and prosecution. Grounds are provided for the fact that criminological features of objects of criminal offence in construction sector allow to identify possible ways of commission, typical traces and criminal’s identity. It is proved that officials and other individuals who commit crimes in construction sector possess data on specific processes, operations and construction stages which provides multiple opportunities to develop plans and schemes for fraudulent activities aimed at embezzlement of material resources and financial assets and conceal facts indicating the crime commission. This research results in conclusion that identification of objects of criminal offence in construction sector is closely connected with methods of its commission and other related mechanisms including the environment. This connection is traced also in classifications of specific crimes related to construction sector.Downloads
