Monitoring of Threats to the State National Security: Foreign Experience and Ukrainian Realities of Public-Legal Provision
Abstract
The article defines the place of monitoring among other publicly-legal means of ensuring national security of the state. The concept of threats to national security as a set of events, phenomena, processes and other factors, which endangers the individual, society and state in a certain sphere and detrimental to their vital interests, is outlined on the basis of analysis of the current legislation and scientific research.
The principles on which the state system of monitoring the threats to the national security of a country should be based is outlined.
The system for monitoring national security in Ukraine should be based on the use of existing organizational structures of monitoring entities and also function on the basis of a single normative, organizational and methodological support, the consolidation of components and unified components of this system.
In order to create the legal basis for the functioning of the national security monitoring system in Ukraine, an amendment to the draft Law of Ukraine «On National Security of Ukraine» is proposed in a separate section V-A «Monitoring in the National Security and Defense Sector», which should reflect the provisions on the state system for monitoring national security, its concept, goals, tasks, principles and subjects, features of functioning, etc.
The essence and prospects of development of the state monitoring system are considered in the light of positive foreign experience and current Ukrainian realities.
