Abstract

Article provides criminological characteristic of public official’s identity accused of power or authority abuse (social, demographic, criminal-legal, psychological, etc.). Criminological characteristic of public official’s identity accused of committing a crime under Article 364 of the Criminal Code of Ukraine defines criminals as university-educated men aged 40–54, with no criminal background, ranked as 5–7th category public officials (local authorities). The definition of «civil servant» is of broader nature than «public official». First includes individuals in positions characterized by organizational or administrative functions without the status of public officials. Therefore public officials are identified as special subjects of all public service crime categories including power or authority abuse. Detailed study and integrated specification of public official’s identity accused of power or authority abuse provides an opportunity to identify a mechanism of criminal behavior, its determination and provision of grounded recommendations for public service crime prevention. The abovementioned study of public official’s identity accused of power or authority abuse must be performed in comprehensive manner with due attention to identity’s peculiarities. It will help to define the factors of identity’s criminal genesis in order to design and take adequate correctional and preventive measures.
