Peculiarities of the Initial Stage of the Crimes’ Investigation in the Sphere of Construction in Some Foreign States
Abstract
The article provides analysis of the initial stage of construction crimes investigation in foreign states with proposals as to the improvement of Ukrainian methodology regarding the investigation of the abovementioned crimes. The author stresses the value of specific methods, applied by law enforcement agencies in the USA and the EU states for Ukraine. In these states the organization and the methodology of pre-trial investigation includes collection and analysis of financial documents owned by the construction company and its contracting parties. Analysis of the financial documents is performed by auditors, accountants and economists. In foreign states economists are usually involved not only as experts responsible for relevant examination procedures but also as participants of the investigative teams. One of the best practices proposed for implementation in Ukraine is the establishment of the Unified Register of Construction Equipment thus promoting reimbursement of damage, detection of stolen property and prevention of other crimes. To improve the quality of pre-trial investigations, attention must be paid to the enhancement of investigator’s skills, his/her awareness regarding financial and business operations within the specified construction site, acquiring knowledge in the area of accounting, public procurement procedures, taxation and other construction-related issues which may potentially lead to the crime commission. The access to the state registers and other open data sources with the use of the analytical tools including the Intelligence Led Policing is of the extreme importance must be given.
