Novative Concept of Understanding Subjects Municipal-Legal Relations
Abstract
In legal science, the doctrine of legal relationships is one of the most complex, debatable, relevant and significant issues both in the scientific and theoretical, and in practical terms. This thesis takes on special significance with regard to municipal law – the sphere of national law of Ukraine, which is currently developing rapidly and municipal-legal relations, where the rules of this field of law are materialized. After all, municipal-legal relations are a vivid reflection of the realization of law, its efficiency and effectiveness, and demonstrate directions for the improvement of legal norms. Despite a large number of studies devoted to the problems of municipal-legal relations, the subjects of municipal-legal relations did not find their proper coverage in the science of municipal law. It is worth
noting that without a clear scientific and theoretical characterization of the subjects of municipal-legal relations it is impossible to speak about the effectiveness of municipal law. After all, under these conditions, the issue of legal personality as a complex concept remains unresolved. The subjects of municipal-legal relations are individual or collective members of social relations, which, based on the norms of municipal law, have municipal legal capacity and are the bearers of subjective rights and legal obligations in the field of realization of the right to local self-government.
