Land relations in Ukraine as object administrative and legal regulation

Abstract
object of administrative and legal regulation and to outline their specific totality (species). Under land relations as the object of administrative and legal regulation it is suggested to understand such social relations that, being based on land ownership, arise while realizing established functions of the state governing as a result of using legal, institutional and economic measures aiming at ensuring proper use and protection of lands as a special natural resource by the competent public authorities. It is established that the objective of administrative and legal regulation of land relations is provision of realization and protection of the rights, freedoms and legitimate interests of physical persons and legal entities concerning the possibility of possession, use and disposal of a land. Singling out the main features of land relations that are the object of administrative and legal regulation made it possible to directly identify those that are governed by administrative law: 1) relations in the sphere of ensuring the proper use of lands, or relations in the field of managing land fund; 2) relations in the field of land protection (security land relations). It is determined that relations in the sphere of ensuring the proper use of lands include: planning of land use, organization of the transfer of land into ownership, land cadastre management, land management. It is offered to divide security land relations into generally security land relations and jurisdictional land relations. The first of them are in the use of technologically contaminated lands, realizing land conservation and compulsory termination of rights to a land, control over land use and protection. In turn, the jurisdictional land relations are caused by proceedings about administrative offenses for violating land laws and resolving land disputes.Downloads
