CONSIDERATION OF THE CHILD’S VIEWS IN DECIDING A TERMINATION OF PARENTAL RIGHTS DISPUTE
Abstract
У статті проаналізовано норми вітчизняного та міжнародного законодавства,
що регламентують питання участі дитини у вирішенні спорів про позбавлення
батьківських прав. Акцентовано увагу на наукових поглядах провідних психологів, які
вивчають особливості дитячої психіки з метою визначення ступеня зрілості особи
як критерію її можливої участі в зазначених спорах. Виявлено колізійні положення
нормативно-правових актів з питань щодо участі дитини та врахування її думки
у вирішенні спорів про позбавлення батьківських прав і запропоновано зміни для їх
подолання.
