THE SPECIFICS OF THE CRIME SCENE, WITHIN THE CIRCUMSTANCES, WITH MITIGATING OR AGGRAVATING FACTORS IN DETERMINING THE PUNISHMENT
Abstract
Розглядається малодосліджена проблема кримінального права – законодавче
відображення місця вчинення злочину як невід’ємного компонента в межах низки
обставин, які пом’якшують чи обтяжують покарання. Наголошується на тому, що
увага науковців і практиків до цих кримінально-правових аспектів здатна відігравати
помітну роль під час ухвалення судових рішень – їх належної обґрунтованості в частині
диференціації відповідальності та дотримання принципу домірності (справедливості)
покарання, що призначається винуватим особам. Розкрито зміст зазначених обставин
в аспекті предмета дослідження.
Ключові слова: місце вчинення злочину, обставини, що пом’якшують та
обтяжують покарання, призначення покарання, кримінальне правопорушення,
диференціація кримінальної відповідальності.
