EVALUATING THE RESULTS OF USING TECHNICAL MEANS DURING UNDERCOVER (SEARCHING) ACTIONS
Abstract
У статті акцентовано увагу на актуальності використання технічних засобів під
час проведення негласних слідчих (розшукових) дій у кримінальному процесі України.
Як результат такого використання розглянуто електронні докази, які є предметом
оцінки суду щодо питання їх допустимості в кримінальному провадженні, а також
можливості спиратись на них під час прийняття судом рішення по суті.
Наведено окремі судові рішення, що стосуються оцінки результатів використан-
ня технічних засобів під час проведення негласних слідчих (розшукових) дій та форму-
ють сталу судову практику. Вказано основні мотиви суду, якими він керується під час
оцінювання результатів використання технічних заходів.
