ELIMINATING LEGISLATIVE DEFICIENCIES IN CERTAIN ISSUES OF INTELLECTUAL PROPERTY RIGHTS
Abstract
У статті проведено аналіз положень Конституції України, Цивільного кодексу
України, законів України «Про медіа» і «Про авторське право і суміжні права» та
міжнародно-правових актів, які є частиною національного законодавства України
щодо можливості примусового відчуження майнових прав суб’єктів авторського
права і/або суміжних прав на їх відповідність одне одному. Вказано на протиріччя та
неузгодженості, які містять названі нормативно-правові акти. На підставі аналізу
чинного законодавства та міжнародних угод надано пропозиції щодо внесення змін
та доповнень у законодавство України стосовно майнових прав суб’єктів авторського
права та суміжних прав.
