INTERSCIENTIFIC CONNECTIONS OF CRIMINAL LAW: MEANING AND EXAMPLES OF FUNCTIONING
Abstract
У статті розвинута думка, згідно з якою термінологічне позначення певного виду
зовнішнього зв’язку кримінального права має спиратися на відповідну форму розуміння
кримінального права. На підставі цього пропонується зв’язки науки кримінального
права з іншими науками позначати терміном «міжнаукові». Розкривається зміст
поняття «міжнаукові зв’язки кримінального права». Наводяться приклади зв’язків
науки кримінального права з філософією, психологією, іншими науками. На прикладі
прогалин реформи кримінального законодавства показано існування комбінованих
міжнаукових зв’язків, врахування яких слід визнати обов’язковим для створення
якісного продукту правотворчості.
