FORCED ALIENATION OF A LAND PLOT AND OTHER IMMOVABLE PROPERTY SITUATED THEREON FOR REASONS OF PUBLIC NECESSITY
Abstract
У статті проаналізовано проблемні питання законодавчого регулювання
примусового відчуження земельних ділянок приватної власності, інших об›єктів
нерухомого майна, що на них розміщені, з мотивів суспільної необхідності. На підставі
системного аналізу законодавства та судової практики щодо його застосування
запропоновано вдосконалення ч. 3 ст. 22 КАС України з метою усунення в ній норм, що
дублюють одна одну. Для формування єдиної правозастосовчої практики обґрунтовано
необхідність доповнення Закону України «Про відчуження земельних ділянок, інших
об’єктів нерухомого майна, що на них розміщені, які перебувають у приватній
власності, для суспільних потреб чи з мотивів суспільної необхідності» нормою, яка
має визначати строк, зі спливом якого припиняються переговори щодо умов викупу
для суспільних потреб земельної ділянки, інших об’єктів нерухомого майна, що на ній
розміщені.
