APPLICATION OF THE CATEGORY “SYSTEM” IN CRIMINAL LAW: METHODOLOGICAL ASPECT
Abstract
У статті розглядається загальний філософський і методологічний фон застосу-
вання наукової категорії «система» крізь призму кримінального права. Розрізняються
категорії «система кримінального права» і «кримінально-правова система». Проілю-
стровано, що наукове розуміння поняття «кримінально-правова система» в сучасних
умовах лише складається і є перспективним напрямом вивчення. Висловлено погляд,
згідно з яким пояснювальна функція науки вимагає застосовувати категорію «систе-
ма» у кримінальному праві не в онтологічному, а в епістемологічному розумінні. На
підставі філософських категорій загального, особливого й окремого наведено приклади
застосування наукової категорії «система» в аспекті кримінального права.
