PROCEDURAL POWERS OF THE HEAD OF THE NABU DETECTIVE UNIT IN COMPARISON WITH FUNCTIONAL POWERS OF OTHER PRE-TRIAL INVESTIGATION AUTHORITIES: UNITY AND DIFFERENTIATION OF PROCEDURAL FUNCTIONS
Abstract
Abstract. The article presents a comprehensive study of the criminal procedural status and powers of the head of the detective unit of the National Anti-Corruption Bureau of Ukraine (NABU) within the system of pre-trial investigation bodies. Particular attention is paid to the provisions of paragraph 8, part 1, article 3 of the Criminal Procedure Code of Ukraine, which explicitly recognizes this official as the head of a pre-trial investigation body. This legislative provision provides a foundation for defining their procedural status, comparable to similar positions within the structures of the National Police of Ukraine, the State Bureau of Investigation, and the Security Service of Ukraine. The study highlights the specific features of the procedural functions of the head of the NABU detective unit, including the appointment of a detective or group of detectives, oversight of deadlines and the quality of pre-trial investigation, approval of certain investigative actions, and coordination with other participants in criminal proceedings. The author emphasizes the importance of clearly distinguishing between administrative and procedural powers, which is a necessary condition for preventing conflicts of competence and ensuring effective management of anti-corruption investigations. The article also analyzes problematic aspects of applying these powers in practice, particularly the lack of proper regulatory mechanisms at the level of NABU's internal acts, which complicates the implementation of the provisions of the Criminal Procedure Code. The article substantiates the need to align NABU’s internal regulatory framework with the norms of criminal procedural legislation. Based on a comparative analysis with other law enforcement bodies, conclusions are drawn regarding the unity and differentiation of procedural functions, and proposals are made to improve current legislation. The research results may be useful for legal practice, law-making activity, and the training of personnel for anti-corruption institutions.
