Organizational and Tactical Forms of Documentation

Abstract

Abstract. This article examines the process of documentation, which is based on the scientifically grounded activities of operational staff in recording crimes (criminal acts and the criminal conduct of individuals), taking into account the specific characteristics of the sphere of social relations in which crimes requiring documentation are committed. The aim of the article is to define the content of documentation and to identify its organisational and tactical forms. It has been established that this can be carried out during the process of identifying (and recording) initial information, both prior to the commencement of the pre-trial investigation and in parallel with it; operational and investigative measures may be initiated prior to the commencement of the pre-trial investigation and concluded during its conduct; that is, the commencement of the pre-trial investigation does not constitute grounds for terminating the documentation. It has been established that documentation is intended not only to record the facts of crimes being prepared or the criminal actions of persons preparing to commit a crime, but also to fulfil a number of tasks during the pre-trial investigation. The list of operational-investigative measures also includes those that have no equivalent in covert investigative (search) actions; therefore, the content of documentation through the conduct of operational-investigative measures does not duplicate the content of documentation carried out in the process of ensuring the ability to execute the investigator’s instructions regarding the conduct of such actions. Documentation consists of a series of interrelated actions which may not cease upon the completion of the pre-trial investigation, but continue thereafter, albeit in a different capacity. It has been concluded that the organisational and tactical forms of documentation include: the recording of the signs of a crime, carried out during the process of its detection and the verification of initial information; the recording of the criminal actions of a person preparing to commit a crime, or the fact of such preparation; recording the facts of the offence, carried out during the operational and investigative support of criminal proceedings; recording the elements of a specific offence, carried out during covert investigative (search) operations; recording criminal acts during the operational support of criminal proceedings at the stages of court proceedings and after the verdict has been handed down.
