Current Status and Development Directions of Forensic Support of Criminal Proceedings
Abstract
Abstract. The effectiveness of achieving the tasks of criminal proceedings directly depends on the proper provision of the process of pre-trial investigation and trial with forensic means, methods, techniques, that is, systematic and comprehensive forensic support. The article is devoted to clarifying the characteristics of forensic support of criminal proceedings under modern conditions. Forensic support of criminal proceedings is aimed at working with various sources of forensically significant information, covers both traditional, proven by many years of theory and practice, forensic means and techniques, and forensic innovations, which are based on the best new domestic achievements of science and practice and borrowing from the best experience of foreign countries. The concept of «forensic support» from a theoretical aspect can be characterized as a separate doctrine of the science of forensic science, which is aimed at forming a scientific basis for the applied forensic means, methods and techniques of activity under dynamic conditions associated with changes in legislation, the development of scientific and technological progress, solving current problems of society, in order to achieve the tasks of criminal proceedings. From a practical aspect, we should talk about the use of forensic means, methods and techniques of activity in criminal proceedings, which are implemented by the prosecution, the defense and the court as a body of justice. The actual forensic support is represented by the following structure. The theoretical basis is the general theory of forensic science, and three structural elements are: forensic technique (technical-forensic support), forensic tactics (tactical-forensic support), forensic methodology (methodological-forensic support). Forensic support of criminal proceedings is implemented both during the pre-trial investigation and during the trial.
