Legal Principles of Information and Analytical Support for the Activities of the State Bureau of Investigation
Abstract
Abstract. The article examines the legal foundations of information and analytical support for the activities of the State Bureau of Investigation as one of the key law enforcement agencies of Ukraine. Theoretical approaches to understanding information and analytical support are analyzed, and its place in the mechanism of implementing the law enforcement function of the state is determined. The system of regulatory legal acts that regulate the information and analytical activities of the State Bureau of Investigation is considered, and problematic aspects of legal regulation in this area are also outlined. It is proven that the current legislation of Ukraine is characterized by a fragmented approach to the regulation of information and analytical support of the activities of the State Bureau of Investigation. Unlike the laws regulating the activities of the National Police of Ukraine, the Security Service of Ukraine, and the National Anti-Corruption Bureau of Ukraine, the Law of Ukraine “On the State Bureau of Investigation” does not contain a systematic definition of either the concept of information and analytical support or its place in the structure of powers of this body. At the same time, a comparative legal analysis using the example of the Law of Ukraine “On the Bureau of Economic Security of Ukraine” showed that the information and analytical activities of this body are enshrined at the level of law with a simultaneous definition of the principles of its implementation, guarantees of information protection, and the limits of interference with human rights. Such an approach ensures the unity of law enforcement practice and increases the level of institutional capacity of the Bureau of Economic Security of Ukraine. The main directions for improving the Law of Ukraine “On the State Bureau of Investigation” are proposed, in particular: defining at the legislative level the concept and tasks of information and analytical support; consolidating the relevant powers of the State Bureau of Investigation; defining the subjects of analytical activity and the principles of its implementation; establishing guarantees for the protection of information and human rights; as well as granting powers to detail the relevant provisions in subordinate regulatory legal acts. The implementation of the proposed changes will contribute to the formation of a holistic and coordinated system of legal regulation of information and analytical support for the activities of the State Bureau of Investigation, increasing the efficiency of its functioning and bringing national legislation closer to modern European standards in the field of law enforcement. The proposed amendments to the Law of Ukraine “On the State Bureau of Investigation” are comprehensive in nature and are aimed at increasing the efficiency of information and analytical support for the Bureau’s activities, eliminating legal uncertainty, and ensuring compliance with the rule of law.
