Constitutional and Legal Status of a Person in Entrepreneurial Activity in Ukraine

Abstract

Abstract. The relevance of studying the status of a person in entrepreneurial activity is due to understanding of a business entity as both an individual entrepreneur (a person and citizen) and collective entities of entrepreneurial activity (legal entities). The purpose of the study is to characterize the content of the constitutional and legal status of individuals and legal entities. To achieve this goal, the research employed methods of observation and comparison, abstraction, analysis and synthesis, as well as the method of ascending from the abstract to the concrete. The scientific works of scholars concerning the researched issue have been analyzed. The author proposes a definition of the constitutional and legal status of individual and collective business entities within the constitutional law of Ukraine. The connection between business entities and scientific as well as practical tasks is emphasized. Among the scientific objectives are the issues of identifying the features and definition of business entities. The practical objectives of the research include the characterization of the practical implementation of entrepreneurial legal relations in Ukraine. It is noted that the elements constituting the content of the constitutional status have not been fully explored. Different approaches exist regarding the understanding of entrepreneurs’ rights and freedoms and their legal capacities. It is concluded that the constitutional and legal status of business entities is regulated by constitutional norms and principles, which are further specified by current legislation governing the sphere of entrepreneurial activity. The practical value of the research lies in the proposals for further analysis of the suggested areas within constitutional, civil, and commercial law.
