Legal Protection of Cultural Heritage in the Conditions of Armed Conflict: State and Directions of Scientific Research in Ukraine
Abstract
Abstract. The relevance of the study is due to the growing role of cultural heritage as a value-normative factor of legal reality in conditions of deep socio-cultural transformations, armed conflicts and crises of legitimacy of law. In modern conditions, cultural heritage increasingly appears not only as an object of protection, but also as a semantic resource for the reproduction of values, collective memory and legal identity. For Ukraine, this issue is of particular importance in connection with military aggression, systemic threats of destruction, damage and appropriation of cultural heritage objects, as well as the need for philosophical and legal rethinking of its role in the formation of value principles of law and order and legitimacy of law. The purpose of the article is to analyze the state of scientific research on cultural heritage from a legal perspective and determine the main directions of further legal research in this area. The article considers cultural heritage not only as an object of legal regulation, but also as a value-normative phenomenon of legal reality, associated with legal culture, collective identity, historical memory and the idea of intergenerational responsibility. The methodological basis of the study is a combination of axiological, ontological and hermeneutic approaches, as well as elements of interdisciplinary analysis, which allows overcoming the limitations of sectoral-legal and normative concepts and revealing the semantic dimensions of the legal understanding of cultural heritage. The scientific novelty of the article lies in the systematization of scientific approaches to the study of cultural heritage in the legal dimension. As a result of the study, the prospects for the development of legal studies of cultural heritage in the context of protecting rights, overcoming value crises and ensuring the sustainability of the legal system and national resilience are outlined.
