NORMATIVE AND LEGAL FRAMEWORK GOVERNING THE USE OF CONTACT AND REMOTE-CONTACT ELECTROSHOCK DEVICES AS A SPECIAL MEANS BY POLICE OFFICERS IN THE WESTERN EUROPEAN COUNTRIES
Abstract
У статті досліджено стан правового регулювання застосування поліцейськими в
Україні електрошокових пристроїв контактної та контактно-дистанційної дії (елек-
трошокерів). Визначено, що в національному законодавстві сформовані загальні пра-
вові підстави застосування поліцейськими електрошокерів, але не сформовані правові
вимоги до порядку, процедури, стандартів, навчання поліцейських застосуванню елек-
трошокерів тощо. Вивчено досвід у цій сфері країн Західної Європи (Великобританії,
Німеччини, Австрії, Бельгії, Іспанії, Італії, Португалії, Нідерландів, Фінляндії, Франції,
Швеції). Запропоновано напрями вдосконалення нормативно-правового регулювання
застосування поліцейськими в Україні електрошокерів.
