THE PHENOMENON OF ANTI-COMPETITIVE CONCERTED ACTIONS (BIDRIGGING) IN PUBLIC PROCUREMENT IN THE CONSTRUCTION INDUSTRY
Abstract
У статті проаналізовано феномен антиконкурентних узгоджених дій у сфері пу-
блічних закупівель з огляду на специфіку галузі будівництва.
Досліджено не тільки чинний адміністративно-правовий механізм обмеження до-
ступу до будівельних публічних закупівель на підставі рішень Антимонопольного ко-
мітету України та його територіальних відділень, але й чинний неявний фактичний
механізм обмеження розміру штрафу, якщо наслідки антиконкурентних узгоджених
дій є на регіональному ринку. Вперше встановлено, що формальне прийняття Анти-
монопольним комітетом України та його територіальними відділеннями рішення про
притягнення до відповідальності за порушення у вигляді вчинення антиконкурентних
узгоджених дій, що стосуються спотворення результатів тендерів, є фактичною за-
бороною брати участь у публічних закупівлях.
