Abstract
This article provides a detailed analysis of the formation of the right to health, the essence of the determinants of the «right to health» and identifies its components. Determined that «human rights» – a combination of natural features and interest, which are enshrined and protected by the state, having the purpose of life support and meet their human needs at the heart of which there is human dignity and freedom of activity in different areas of public life. Investigated and found the concept of «right to health». The emphasis on certain aspects debatable issue of the proclamation of the law, which provides one of the highest social values – health. At the same time studied the scientific literature, which debated the definition (formulation) human rights, which is intended to provide the specified benefit (value). Analyzed in detail the international legal acts and scientific literature on the subject content of the test of law. Noted that used terminospoluchennya – the right to health, the other – the right to health. Analysis of available author of international instruments revealed that used definition of rights including: the right to a standard of living, including food, clothing, housing and medical care and necessary social services, adequate for the health, the right to the highest attainable standard physical and mental health), the right to health, right to health, right to the enjoyment of the highest attainable standard of health and facilities for the treatment of illness and rehabilitation of health, the right to protection of their health to the extent , which permit preventive measures that exist, and treatment of disease and should be able to achieve the highest level of care for themselves.
