Conceptual Frameworks of the Prevention of Acts Which Caused Menace to the Public

Abstract

This article is concerning on definition of “prevention of acts which caused menace to the public” as the most optimized to identify such activity. Prevention of acts which caused menace to the public is to be understood as a process consists of two parts: 1) denial of beginning of committing acts which caused menace to the public; 2) interdiction of acts which caused menace to the public and were already started (e.g. preparing of crime, attempt of crime, protracted or lengthening crime). Prevention of acts which caused menace to the public is an activity of private persons and legal entities referring to prophylactic, denial and interdiction of the abovementioned acts. Such prevention must have tripartite structure and comprise of: 1) prophylactic – elimination of causes and conditions of committing; 2) denial – deliberate avoiding of acts which caused menace to the public by persons who had relevant intent but didn’t make any preparations; 3) interdiction – stopping (interrupting) of such acts, that already been started but didn’t been accomplished (e.g. preparing of crime, attempt of crime, protracted or lengthening crime). Prevention of acts which caused menace to the public is complicated process elements of which are composed an ascertain system. At the same time some elements of this system have its own structure and consequently are original subsystems. The system of prevention of acts which caused menace to the public consists of objects, subjects and measures. Basically the effective prevention of acts which caused menace to the public is assured by qualitative criminal law norms which constitute the responsibility for relevant crimes, results of analysis of quantitive and qualitative indexes of such crimes, their determinants, criminological picture and typology of criminal person as well as a system of social, economical, political, cultural, legal and other means which cover ceaseless cycle of prevention activity beginning and ending with elimination of causes and conditions of committing acts which caused menace to the public and is performing on general, special and individual levels.
