Abstract
Article «Search as forensic tactical method» provides analysis of search activity in comparison with other non-verbal forensic tactical methods on the basis of forensic theory, criminal process and current practical activity of pre-trial investigation bodies. Chosen topic is justified by increasing amount of complaints received by courts concerning procedural activity of pre-trial investigation bodies in the context of investigative actions performance and measures taken in the course of criminal proceeding. Article is aimed to identify the search, examination and temporary access (to items and documents) locations during proving stage in pre-trial investigation. Research subject is presented by non-verbal forensic tactical methods including search, examination and temporary access to items and documents. Methodological basis of research comprises description, analysis and comparison. Article presents overview of a wide range of scholarly views on non-verbal forensic tactical methods relevance. Author defines basic approaches to definition of terms and key characteristics of studied investigative actions. It is stressed that procedural arrangement, some tactical peculiarities of search, examination and temporary access to items and documents are similar in some way but there is a number of differences affecting the proving process and investigative tactics in criminal proceeding. After detailed study of court practice author notes that unfortunately pre-trial investigation bodies do not pay enough attention to procedural delimitation of examination and search. In conclusion author notes that procedural form of mentioned investigative actions and means of criminal proceeding enforcement is characterized by a number of verbal and non-verbal elements. Tactical similarity and procedural distinction of non-verbal forensic tactical methods are the priority areas of further research in terms of pre-trial investigation methodology improvement.Downloads
